Wrongful Death

Sometimes a serious car, bus, or airplane crash, or a malpractice or workplace incident, a food poisoning incident, or a defective drug can result in the death of a victim. When this happens, the family can retain a Honolulu litigation attorney to bring a claim for wrongful death. The spouse of the victim, their children, their parents, or the representative of their estate can bring the claim, as well as anyone else who depended financially on the victim at the time of their death. Damages can account for the lost enjoyment of life, income support, funeral and burial expenses, and the costs of treatment before death, as well as the emotional land financial losses suffered by family members based upon their relationship with the victim.

Medical Malpractice

An egregious error by a doctor, nurse, hospital, or other health care provider can lead to consequences that change a patient’s life forever. Some of the most common types of medical malpractice include a misdiagnosis, a delayed diagnosis, a surgical error, an anesthesia error, or an error in conducting a test. A victim can hold a health care provider accountable for their negligence by bringing a medical malpractice claim. This involves showing that the health care provider did follow appropriate or required practices, and the patient was harmed as a result. The victim likely will need to retain a medical professional to testify as an expert witness. Our litigation attorneys can help people Hawai‘i retain expert witnesses, build these complex cases and with them, either through settlement or trial.

Product Liability

Every day, unsafe products cause serious and catastrophic injuries and death. A manufacturer has a duty to research, engineer, produce, and sell their products in a manner that makes their products safe for their intended use and in a manner that poses no unreasonably dangerous threat of harm to the consumer. When flawed items are released into the market, manufacturers should be held accountable.

Product defect falls into three main categories:
  1. Defective design – A design flaw means that there a problem with the blueprint of the product that makes it unreasonably unsafe. A product may have been designed in a manner that makes the product unsafe for its intended use, for example a children’s toy with small component parts that can be a choking hazard, or a car with airbags that fail to deploy in a serious collision. Other times, product manufacturers have the ability to choose between different available materials or technologies, and the failure to make the safest choice can lead to devastating losses.
  2. Manufacturing defect - A one-time error that affected a specific product or a specific group of products. For example, home appliances put together in an assembly line production with a missing screw or a missing safety mechanism can cause electrocution, fire hazard, or explosion.
  3. Failure to warn - A failure to warn, also known as a marketing defect, means that the product lacked instructions or warnings that were needed to make it safe for use. A chair that collapses because no weight limit was conspicuously printed for users to see, or a carbon monoxide or fire detector which fails to instruct users to follow appropriate testing practices, can lead to serious danger.
  4. At Bickerton Law Group, we fight to maintain and increase safety standards for the community. If you have been injured as a result of automotive defects, consumer product defects, or defective medical products, please call us today for a free case evaluation.
Automotive Defects

If you have been injured in an automobile either because of driver negligence or system failures with the car itself, we may be able to help. Although car manufacturers tout the safety aspects of their cars, injury can occur because of cheap materials, the failure to implement the safest technology, and poor design. The attorneys at Bickerton Law Group have the experience and know-how to determine whether your injury has resulted from an automotive product flaw.

Driver Assistance Technology

Crash Avoidance Technology (CAT) or Driver Assistance Technology (DAT), the “smart” systems in cars, are now becoming widely implemented. These technologies include collision warning, automatic emergency braking, and rearview cameras, to name a few. The failure of an auto manufacturer to use available safety technology, or designing a vehicle with substandard technology that fails to perform as expected, can cause catastrophic injury.

Defective Tires

Tread separation and tire blowouts can occur as a result of dangerous design or mistakes in the manufacturing process.

Rollovers and Crashworthiness

Auto manufacturers have a responsibility to design and manufacturer their cars to keep occupants safe from foreseeable dangers. When a vehicle rollover or crash occurs, occupants can be crushed as a result of poor design and cheap materials.

Seat Belt Failures

Seat belt systems can fail as a result of a number of errors in the design and manufacture process. Defective webbing material, retractor failures, and excessive spooling are a few of the most common injury-causing defects.

Airbag Failures

Exploding airbags have been in the news recently, but other design and manufacture problems exist. For example, if an airbag deploy unexpectedly and causes a driver to lose control of his or her vehicle, serious and catastrophic injury may result. On the other hand, if a collision occurs and the airbag fails to deploy or deploys in a manner that increases injury to the driver or passengers, then there may have been a flaw in the design or manufacturing process.

Defective Child Seats and Infant Carriers

Child safety is our number one priority. Child protective equipment may be recalled for safety reasons but without notice to you, meaning that your loved ones could be at risk. When a product manufacturer decides to use cheap materials in order to increase profits, or fails to perform the proper testing on a product that could have made injury foreseeable, we are there to fight for you.

Consumer Products

Defective products injure unsuspecting consumers in a broad range of situations each day as a result of cheap materials and poorly designed component parts. Serious injury can occur from improper labeling, substandard protocols in testing procedures, and untimely recalls. Choking hazards, burn hazards, and battery explosions are but a few of the common harm mechanisms.

Medical Products

Dangerously designed medical equipment and appliances, such as prosthetic devices, surgical implants, hospital supplies, and diagnostic equipment, can fail or fail to operate as expected, leading to severe and catastrophic injuries.

Product liability claims tend to be more complex than ordinary personal injury claims. This makes it especially critical to retain an attorney to advocate on your behalf. The attorneys at Bickerton Law Group LLLP have the knowledge and experience to fight on your behalf to hold those accountable to the community safety standards we rely on.

If you or a loved one has been injured from the use of a product, you can reach us online or at (808) 599-3811 to set up an appointment and find out more about what our firm can do for you.

Consumer Class Actions

The desire to gain a competitive advantage and increase profits often leads businesses to go too far, engage in unfair practices, and take advantage of consumers or their own employees. They may use false advertising, add hidden fees, or refuse to pay employees overtime and other wages as required. Through class actions, Bickerton Law Group LLLP can help consumers and employees take action against businesses that have taken advantage of or otherwise injured them. We have obtained tens of millions of dollars for our clients in class action cases involving several different industries. Our Honolulu class action lawyers have won substantial verdicts and settlements against banks, hotels, auto dealers, construction companies, among other defendants. We also represent businesses that need to sue their competitors for unfair methods of competition that have harmed or destroyed their business.

Real Estate Litigation

Disputes over real property are often complex and benefit from the guidance of a sophisticated attorney. Real estate litigation can arise from issues related to purchase and sale agreements when one side does not meet the terms of the contract. Disputes can also arise between owners requiring a court to “petition” the property or sell it to divide the proceeds. Real Estate also can involve disputes with cities or other government entities regarding zoning, land use or condemnation, or with a commercial Landlord who is not following the lease. In other cases, a property owner may need to sue a contractor because of problems with the construction process.

Trust Litigation

Sometimes a conflict arises from the terms of a trust. A fiduciary of a trust has a high level of duty to its beneficiaries. We can help a beneficiary bring a claim against a fiduciary when there has been a breach of fiduciary duty, and we can also defend fiduciaries against these claims. Meanwhile, a family member who feels that they should have been included as a beneficiary of a trust may try to contest the validity of the trust. These claims tend to be highly technical, so consulting an attorney is a wise precaution to take, regardless of whether you are the plaintiff or the defendant.
